IP for activities using the resouces

Normally, when there is no NYSBC staff intellectual contribution, all activities of the Member Institutions are governed by the Institution's rules, and any resulting IP is entirely the property of the Member Institution.

IP for activities using NYSBC staff

When there is an intellectual contribution from NYSBC staff, then there is the expectation that interinstitutional arrangements will be made for resulting IP between the Member Institution and NYSBC. This is formally recognized in, e.g., subcontract arrangements ('consortium agreements') when NYSBC received subcontracts from ongoing grants at a Member Institutions for specific work.

Exception for IP-retaining consulting work

In order to enhance the availability of NYSBC resources to faculty at Member Institutions who have a need for occassional, but substantial, use of NYSBC staff, and well as resources, the faculty member may negotiate a contract with NYSBC for use of NYSBC staff as retained consultant(s) with IP being retained wholly by the faculty Member Institution.
  1. NYSBC staff may conduct a small amount of preliminary work for the purposes of assessing the scale of the proposed contract.
  2. The use of facilities will be governed by the normal rules of access and prioritization for the Member Institution
  3. This form of IP-retaining consulting will only be available to full time Faculty of Member Institutions, and is not available to any commercial entity. In the case where there is a commercial entity sponsoring the faculty research, or otherwise involved, the contract will be fully reviewed by the Board's executive committee before approval. The executive committee may recommend that the contract be made with the commercial entity at commercial rates.
  4. In the case of any contract exceeding $30,000/calendar year, the contract will be fully reviewed by the Board's executive committee prior to agreement.
  5. All contracts will be communicated to the Treasurer.
  6. The rate of payment will not be less than the actual cost of the staff member's time, including fringe benefits, full assessment of actual F&A costs, and a markup to benefit all the other Member Institutions to compensate for their loss of opportunity.
